Terms of Service
1. Preamble
These Terms of Service ("Terms") govern the offer, sale, and purchase of goods on the website meuchner.com (the "Site"), operated by Meuchner Inc., a corporation organized under the laws of the State of New York ("Meuchner," "we," "us," or "our").
1.1 Products purchased on the Site (the "Products") are sold directly by Meuchner.
1.2 These Terms must be read and accepted before an order can be placed. If you do not accept these Terms, you will not be able to complete a purchase on the Site.
1.3 The Site offers Products for sale only to individual consumers who are 18 years of age or older and who are purchasing for personal use rather than resale or other commercial purposes (each, a "Customer" or "you").
1.4 Products are currently offered for sale and shipment only to the countries and regions listed on the Shipping page of the Site.
1.5 We reserve the right to limit the quantity of any Product, or type of Product, that a Customer may purchase.
1.6 We reserve the right to decline any order placed by a non-consumer, a person under 18, a buyer in a country not listed on the Shipping page, or any order that does not conform to our commercial policies.
1.7 These Terms do not govern the sale of goods or services by third parties, even where those third parties are reachable through links on the Site. You are responsible for reviewing the applicable terms before purchasing from a third party, and Meuchner is not responsible for goods or services sold by parties other than Meuchner.
2. Purchase Orders
2.1 To purchase a Product, select the item, add it to your cart, and complete checkout by following the prompts on the Site.
2.2 Customers may check out using a registered account or as a guest. Guest checkout requires providing the personal information needed to process and ship the order.
2.3 Before submitting an order, review your cart for errors. Product selection, customization details, shipping address, and payment information are the Customer's responsibility to confirm.
2.4 Submitting an order is an offer to purchase the selected Products on these Terms; it is not itself an acceptance by Meuchner.
2.5 After an order is submitted, we will send an automatic email confirming receipt of the order. This confirmation email is not an acceptance of the order.
2.6 An order is accepted by Meuchner only when we send a shipping confirmation email, or, for made-to-order and bespoke pieces, when we confirm that production has begun.
2.7 We reserve the right to decline or cancel an order — for example, if a Product is unavailable, pricing or product information was displayed in error, payment cannot be verified, or the order does not conform to our commercial policies. If an order is declined after payment has been collected, we will refund the amount paid within a reasonable time.
2.8 Order records are retained for as long as needed to fulfill the order and to comply with applicable recordkeeping laws. Registered Customers can view past orders in their account; guest Customers may contact Customer Service (Section 11) for order information.
3. Characteristics of the Products
3.1 Products sold on the Site are designed and produced by Meuchner. Bespoke and made-to-order pieces are cast to order in 18K gold and may include natural materials, such as gemstones and pearls, whose color, clarity, and markings vary piece to piece; this natural variation is not a defect.
3.2 The principal characteristics of each Product are described on its product page. Because of differences in device displays and photography, the color of a Product as shown on the Site may vary slightly from the Product as received.
3.3 Bespoke and made-to-order Products are produced specifically for the Customer's order and may take longer to ship than ready-to-ship Products. Estimated production and delivery times are noted on the product page or communicated at the time of order.
4. Payments
4.1 Prices for Products are stated in U.S. Dollars ($) and include all applicable taxes unless otherwise noted. Prices do not include shipping and delivery costs, which are shown separately before you complete checkout.
4.2 Prices are subject to change without notice; the price charged is the price in effect at the time your order is submitted.
4.3 Accepted payment methods are listed on the Site at checkout. Payment is charged once your order is submitted and before Products are shipped, except where a deposit or installment schedule has been separately agreed for a bespoke commission.
4.4 Payment card details are transmitted using industry-standard encryption to our payment processor and are not accessible to Meuchner except as needed to process your order, issue a refund, or investigate fraud.
4.5 Products shipped outside the United States may be subject to customs duties, import taxes, or other fees imposed by the destination country. These charges are the Customer's responsibility, are not included in the Product price or shipping cost, and cannot be predicted by Meuchner in advance. Contact the customs authority in the destination country for more information.
5. Delivery
5.1 Products are shipped by the courier(s) identified on the Site's Shipping page. Shipping costs, carriers, and estimated delivery windows are shown on that page and on your order confirmation.
5.2 Delivery times are estimates counted in business days, excluding weekends and holidays; actual delivery may vary, particularly for bespoke or made-to-order pieces.
5.3 Orders must be shipped to an address that can accept signature delivery; we are unable to ship to P.O. boxes or addresses that refuse third-party couriers. Please ensure your shipping address is accurate and complete — Meuchner is not responsible for delays or non-delivery resulting from an incorrect or incomplete address provided by the Customer.
6. Returns, Exchanges & Cancellations
6.1 All sales are final. We do not accept returns, exchanges, or cancellations on any Product except where the Product arrives damaged, defective, or otherwise not as ordered.
6.2 If a Product arrives damaged or defective, contact Customer Service (Section 11) within 7 days of delivery with photos of the issue. We will review the claim and, at our discretion, repair, replace, or refund the Product.
6.3 Bespoke and made-to-order pieces are produced specifically for your order and are final sale once the order is placed. Any deposit or payment made toward a bespoke or made-to-order commission is non-refundable, including where the Customer cancels after the order has been placed.
6.4 This policy does not limit any right or remedy available to you under applicable state or federal consumer protection law.
7. Warranty
7.1 In addition to any craftsmanship guarantee described on the Site, Products purchased in the United States are covered by the implied warranties available under the Uniform Commercial Code as adopted by the applicable state, and, where Meuchner provides a written warranty, by the federal Magnuson-Moss Warranty Act.
7.2 Meuchner provides a limited warranty against manufacturing defects for 6 months from the date of delivery. To make a claim, contact Customer Service within that period after discovering the defect. This limited warranty is in addition to, and does not limit, any warranty rights available to you under applicable state law.
7.3 Normal wear, damage from misuse or accident, and alterations made by a jeweler other than Meuchner are not covered.
7.4 Where a Product is defective, Meuchner will, at its discretion, repair or replace the Product at no cost to the Customer or, if neither is reasonably possible, provide a refund or price reduction.
7.5 To make a warranty claim, retain your order confirmation or receipt as proof of purchase. Contact Customer Service for more information about your rights under applicable law.
8. Privacy
8.1 Meuchner's collection and use of Customer personal information is described in our Privacy Policy, available on the Site, which forms part of these Terms.
9. Governing Law and Resolution of Disputes
9.1 These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles, and by applicable U.S. federal law.
9.2 Any dispute arising out of or relating to these Terms or a purchase on the Site will be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, and each party consents to personal jurisdiction there.
9.3 Nothing in these Terms limits any right a Customer may have under applicable consumer protection law, including the right to bring a claim in small claims court.
10. Amendments to Terms of Service
10.1 We may amend these Terms at any time, including to reflect changes in our practices or in applicable law. The version of these Terms in effect on the date an order is submitted governs that order. We encourage Customers to review these Terms periodically.
